What is Debt Review Removal?
Debt Review Removal is the legal process of removing your Debt Review status when you meet the requirements of the National Credit Act (NCA).
Once your Debt Review status has been removed from the credit bureaus, you can move forward financially and continue building your future.
Many people believe they can simply cancel Debt Review whenever they choose.
Unfortunately, this is not how the legal process works.
South African law, the National Credit Act (NCA), there are only three lawful ways to be removed from Debt Review, and the option available to you depends on your individual circumstances.
The legal process depends on factors such as:
- whether you have only applied for Debt Review;
- whether you have been declared over-indebted;
- whether a court order has already been granted; or
- whether you were placed under Debt Review fraudulently.
Most people are unaware that their Debt Review status and credit bureau information play an important role in determining which legal option is available.
For this reason, it is important to understand your current legal position before taking any action.
Who may qualify for Debt Review Removal?
Every situation is different.
The examples below are common circumstances where Debt Review Removal may be legally possible.
Whether you qualify depends on your individual circumstances and the legal requirements that apply to your case.
- Your financial circumstances have improved, and you can now afford your original contractual repayments.
- You entered Debt Review, but a court order has not yet been granted.
- You have settled all qualifying debts and meet the legal requirements for a clearance certificate.
- You believe you were placed under Debt Review fraudulently or without your knowledge.
- Your current legal position indicates that one of the lawful Debt Review Removal options may be available to you.
Who does not qualify for Debt Review Removal?
Debt Review Removal is a legal process governed by the National Credit Act (NCA).
Unfortunately, not everyone qualifies for Debt Review Removal, and taking the wrong advice can make your situation worse.
Debt Review Removal is generally not the correct option if:
- A court order has already been granted, and you do not meet the legal requirements for removal.
- You still cannot afford your original contractual debt repayments.
- You simply want to borrow money again without meeting the legal requirements.
- You have been promised an instant Debt Review Removal or guaranteed results.
- You have been advised that you can simply "cancel" Debt Review without following the legal process.
Were you placed under Debt Review without your knowledge?
If your profile was incorrectly placed under Debt Review because of an error, fraud, or miscommunication, you may have the right to lodge a formal complaint with the National Credit Regulator (NCR) and request that the matter be investigated.
This may apply if:
- You never applied for Debt Review.
- The Debt Review listing was made without your knowledge or consent.
- You were led to believe that you were signing up for a savings plan or a consolidation loan.
How to lodge a complaint with the NCR
This process may take longer because the NCR must investigate the matter.
Still, it remains a valid and legally recognised process where fraud or an incorrect Debt Review listing is suspected.
Can I legally cancel Debt Review?
The short answer is no.
Under South African law, the National Credit Act (NCA) does not allow consumers to simply cancel Debt Review whenever they choose.
There are only three lawful ways to leave Debt Review, depending on your individual circumstances.
You Applied for Debt Review but Were Not Over-Indebted
Form 17.2(a)
This option applies where you applied for Debt Review, but you are not over-indebted.
Your Debt Counsellor may issue a Form 17.2(a), confirming that you do not qualify for Debt Review, and your status can be updated accordingly.
You Were Declared Over-Indebted, but No Court Order Has Been Granted
If your financial circumstances have changed and you are no longer over-indebted, your Debt Counsellor can approach the court to reject the Debt Review proposal.
If the court agrees, your Debt Review status can be updated.
You Have Completed Your Debt Review
Form 19 Clearance Certificate
Once you have met the legal requirements for a Clearance Certificate, your Debt Counsellor may issue a Form 19 and notify the credit bureaus to update your Debt Review status.
Every situation is different.
The legal process that applies to your circumstances depends on your Debt Review status, your financial position and the legal stage of your matter.
There is no single Debt Review Removal process that applies to everyone.

The Legal Debt Review Removal Process
If your Debt Review Removal application qualifies to proceed through the Magistrates' Court, your matter follows a formal legal process prescribed by the National Credit Act.
Unlike companies that promise quick or overnight Debt Review Removal, a Magistrates' Court application cannot be rushed.
Every legal requirement must be completed before the court can consider your application.

Information & Documentation
We assist you in collecting the information and supporting documentation required for your court application.
Every document is carefully reviewed before being submitted to the appointed attorney so that the legal process can begin correctly.
Legal Pack Preparation
The appointed attorney prepares the legal application, including the founding affidavit, notice of motion and all supporting court documents, for submission to the Magistrates' Court in the area where you reside.
This is because your application must be heard in the court that has jurisdiction over your matter.
Court Application
The legal application is submitted to the Magistrates' Court and enrolled in accordance with the court's procedures.
Before the matter can be heard, the court documents must be served on every respondent in accordance with the court rules.
Court Order
The appointed attorney appears in court on your behalf, so you do not need to attend the hearing.
Once the Magistrate grants the application, an official court order is issued.
NCR Debt Help System (DHS)
Following the court order, our office updates your Debt Review status on the National Credit Regulator's Debt Help System (DHS).
Once the update has been completed, we provide you with confirmation.
The NCR system then verifies the update and notifies the credit bureaux.
Credit Bureau Updates
The relevant credit bureaux update your Debt Review status in accordance with the National Credit Act.
Once the required updates have been processed, your Debt Review listing is removed.
Debt Review Removal Completed
Once all legal requirements have been met and the necessary updates have been completed, your Debt Review Removal process is finalised.
Why Does the Court Process Take 6 to 12 Months?
A Magistrates' Court application follows a legal process that protects everyone involved.
Before the court can hear your application, the founding papers must be served on every respondent, including your previous Debt Counsellor and all of your credit providers.
Each respondent must receive at least 20 business days' notice before the court hearing, and proof that the documents were served must be filed with the court before the matter can proceed.
This statutory notice period alone accounts for approximately one month before a court date is even possible.
The overall timeline also includes:
- Collecting and reviewing your documentation.
- Preparing the legal application.
- Serving the court documents on all respondents.
- Allocating a court date.
- The attorney appearing in court on your behalf.
- Updating the National Credit Regulator's Debt Help System (DHS).
- Updating the credit bureaux once the legal process has been completed.
Throughout this process, Ursula Gouws Consulting and our attorney partners manage the legal process on your behalf.
You are not required to attend court or communicate directly with the respondents.
